Welcome to Viralithm! These Terms of Service ("Terms") govern your use of the Viralithm website and the services provided by our AI agent teams (collectively, the "Service"), operated by Viralithm ("us", "we", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

2. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Viralithm cancels it. You may cancel your Subscription renewal through your online account management page. A valid payment method, including credit card, is required to process the payment for your Subscription.

3. Use of AI Services

Our Service utilizes advanced AI agents to generate content and perform marketing tasks. You are responsible for the inputs you provide to the agents. While we strive for accuracy and quality, the output of the AI is generated and may occasionally contain errors or inaccuracies. You are responsible for reviewing and approving all content before publication or use.

You agree not to use the Service to generate content that is illegal, harmful, defamatory, or infringes on the rights of others.

4. Intellectual Property

The Service and its original content (excluding content generated for you by the AI agents), features, and functionality are and will remain the exclusive property of Viralithm and its licensors. You retain all rights to the content you provide to the Service and the final content generated by the agents for your account.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

6. Limitation Of Liability

In no event shall Viralithm, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Viralithm is established, without regard to its conflict of law provisions.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
